Terms of Service

This is a reference English translation of our Terms of Service. The Japanese version is the authoritative text and prevails in the event of any discrepancy. The original Japanese version is available at 利用規約 (Japanese).

These Terms of Service (the "Terms") set out the conditions for using the mobile applications (the "App") provided by Kuchibashisoft ("we," "us," or "our"). By downloading or using the App, you are deemed to have agreed to these Terms.

In addition to these Terms, your use of the App is also subject to the terms of the distribution stores (Google Play, the App Store, and others) and to the terms and policies of the third-party service providers used by the App. In the event of any conflict, these Terms govern with respect to the App itself, while each store's and each third-party service's own terms govern the use of those stores and services.

The information collected and the external services used may differ from app to app; these Terms set out the conditions common to the apps we provide. The handling of personal information is governed separately by our Privacy Policy.

Subject to your compliance with these Terms, we grant you a non-transferable, non-exclusive, and revocable right to use the App for your own personal use. This license does not transfer to you any rights in the App or its content.

You may not use the App beyond the scope expressly permitted by these Terms.

Some of our apps may contain mature elements, such as violent or frightening depictions. Please use the App in accordance with the age rating shown for each app in the relevant distribution store.

If a minor uses the App or makes in-app purchases, they must do so with the prior consent of a parent or other legal guardian.

When using the App, you must not engage in any of the following:

• Reverse engineering, decompiling, disassembling, or otherwise analyzing the source code or structure of the App
• Modifying the App, using cheat tools, or otherwise manipulating the game's behavior or outcomes by improper means
• Violating laws or public order and morals
• Infringing the intellectual property, privacy, or other rights or interests of us or any third party
• Interfering with the operation of the App, or gaining unauthorized access to servers, networks, or the like
• Reproducing, redistributing, lending, or commercially exploiting the App or its content without our permission
• Being or being involved with anti-social forces (organized crime groups), or providing benefits to such forces
• Any other conduct that we reasonably deem inappropriate in light of the purpose of these Terms

Some features of the App may allow you to enter text. You are responsible for the content you enter, and you should take care not to enter content that infringes the rights of third parties, or personal information such as names or contact details, or confidential information. You agree that we and the third-party service providers we use may process such input (including transmission, storage, and analysis) to the extent necessary to provide the features.

The App may generate text, such as narration and dialogue, using generative AI. The generated text is intended for entertainment purposes, and we do not warrant its accuracy, completeness, appropriateness, or fitness for any particular purpose. By the nature of generation, unintended expressions may be produced. For details on how entered and transmitted information is handled, please see our Privacy Policy.

Copyright and other intellectual property rights in the App, and in the programs, text, images, audio, and other content, as well as the trademarks and logos, contained in the App, belong to us or to their rightful owners. You may not use them beyond the scope permitted by these Terms.

The App may use external services—such as distribution stores, advertising, usage analytics, and generative AI—in order to provide features, improve quality, and generate revenue. Use of these services is subject to the terms and policies of each service provider.

In apps that display advertising, third-party advertisements may be shown, and we are not responsible for the content of the advertisements or for the services or products they link to. For how information is handled by these services, please see our Privacy Policy and the policies of each provider.

In apps that offer in-app purchases, you can purchase paid items or features through the billing system of each distribution store. Payment is processed by the Google or Apple store, and purchases are subject to the terms of each store.

Whether refunds or cancellations are available after purchase is subject to the conditions set by each store. The content and conditions of use of purchased items are as described at the time of purchase. Purchases by minors must be made with the prior consent of a parent or other legal guardian.

We may change the content of the App, update it, or temporarily suspend or terminate its provision, without prior notice to you.

In addition, if you violate these Terms or any law, or where we otherwise reasonably deem it necessary for the operation of the App, we may, without prior notice, suspend all or part of your use of the App, restrict features, or delete related data. We are responsible for any disadvantage you may suffer as a result of such measures only to the extent provided in these Terms.

We do not warrant that the App will be fit for your particular purpose, that it will produce the results you expect, that it will be available without interruption, or that it will be free of defects or errors.

We are not responsible for third-party content contained in the App, for actions based on your own judgment, or for matters arising from circumstances beyond our reasonable control, such as the state of communications, your device, or external services. Where consumer contract or other laws do not permit such a disclaimer, this section applies only to the extent not contrary to those laws.

Except in cases of our willful misconduct or gross negligence, and only where ordinary negligence is involved, our liability for damages incurred by you in connection with your use of the App is limited to ordinary and direct damages actually incurred, and we are not liable for lost profits, indirect damages, special damages, or consequential damages.

Where we are liable for damages in an app that offers in-app purchases, the amount of compensation may be limited to the amount you paid as in-app purchases for that app. Where consumer contract or other laws do not permit such a limitation of liability, this section applies only to the extent not contrary to those laws.

We may change these Terms within the scope permitted by law. Where a change to these Terms conforms to the general interests of users, or where the change does not conflict with the purpose of these Terms and is reasonable in light of the necessity of the change, the appropriateness of its content, and other circumstances, we may change these Terms by notifying users of the content of the amended Terms.

Where we make a change that materially affects users, we will set an effective date and give advance notice by an appropriate method, such as on this website, within the App, or on the distribution stores. Minor changes take effect when posted on this website.

These Terms are governed by the laws of Japan. In the event of a dispute between us and a user regarding the use of the App or these Terms, the district court or summary court having jurisdiction over the location of the operator shall be the court of exclusive agreed jurisdiction for the first instance.

• Even if any provision of these Terms, or part of one, is held invalid or unenforceable by law, the remaining provisions of these Terms shall remain in full force and effect.
• You may not assign, lend, or otherwise dispose of your status under these Terms, or the rights and obligations under them, to any third party without our prior written consent. If we transfer the business relating to the App to a third party, we may transfer to the transferee our status under these Terms, the rights and obligations under them, and user information.
• Notices or communications from us to users will be made by displaying them on this website or within the App, by posting on the distribution stores, or by email or another method we deem appropriate.
• The authoritative text of these Terms is the Japanese version. Even where a translation into another language is provided for reference, in the event of any discrepancy between the Japanese version and the translation, the Japanese version prevails.
